Many electric bikes are sold with a twist-grip or thumb throttle, and it is one of the most searched questions: is it legal? The answer depends on how that throttle works, not on whether it exists.

The key rule: 6 km/h without pedalling

In the European Union, a pedal-assist bicycle (EPAC, standard EN 15194) may have a throttle only as a starting aid or "walk mode" up to 6 km/h. Above that speed, the motor may only assist while you pedal, with a maximum rated power of 250 W and a cut-off at 25 km/h.

SituationWhat is it legally? What it requires
Throttle up to 6 km/h + pedal assist up to 25 km/h, 250 WBicycleNothing: no registration plate, licence or compulsory insurance
Throttle that moves the bike without pedalling above 6 km/hMoped (L1e vehicle)Type approval, registration plate, insurance, AM licence and an approved helmet
Assistance up to 45 km/h (speed pedelec)MopedThe same as a moped

What happens if I ride an "unlocked" bike?

Riding on public roads a vehicle that does not meet the requirements of a bicycle and is not type-approved as a moped can lead to fines, the vehicle being impounded and, above all, serious problems with your insurance in the event of an accident. Modifying the controller also usually voids the warranty.

How to choose a legal model

  • Look for a reference to the EN 15194 standard and the European configuration (250 W, 25 km/h).
  • If it has a throttle, check that it is limited to 6 km/h in the EU version.
  • Be wary of listings that advertise 750–1,500 W or 45–50 km/h without mentioning type approval.

Catalogue models with the European configuration: ENGWE O20 Boost, ENGWE M20, DUOTTS C29, DYU C9. If you need more speed, the legal option is a type-approved electric motorbike. Read more in our guide to moped-style electric bikes and the rules.

Frequently asked questions

Is an electric bike with a throttle legal in Spain?

Yes, if the throttle only works as a starting aid up to 6 km/h and the rest of the time the bike is pedal-assisted (250 W, up to 25 km/h).

Do I need a licence for an electric bike with a throttle?

No, if it meets the above. If the throttle moves it without pedalling at more than 6 km/h, it is treated as a moped and requires an AM licence, registration plate and insurance.

Can I remove the 25 km/h limiter?

Technically it is possible on some models, but the bike then stops being a legal bicycle: it becomes a vehicle that would need type approval, and you lose insurance cover and warranty.
